Jason Johnson just wanted to take a break with some Rock Band. Instead, he's taking Microsoft to court.
According to the Madison Country Record, the Illinois man filed suit against the Redmond giant this past week, claiming his Xbox 360 game console ruined three video game discs by scratching them to the point of being unplayable.
Johnson first noticed the problem after trying to play store-bought copies of Rock Band, Rock Band 2 and Grand Theft Auto IV. In the suit, he claims to have heard "unnatural, grinding noises while the game disc was spinning," followed shortly by unreadable disc errors. Upon inspection, he found circular scratches running across the data side of the discs.
Johnson contacted Microsoft directly to resolve the issue, but was purportedly presented with numerous solutions that would require further payment. The suit contends that in doing so, Microsoft violated the Illinois Consumer Fraud and Deceptive Business Practices Act and "breached its duty to act as a reasonable manufacturer" by failing to investigate the issue, warn consumers, or recall consoles known to be defective.
Microsoft should be familiar with the scratched-disc issue, as the company was hit with a class-action suit over the matter back in July of 2007.
Johnson is seeking $50,000 in punitive damages as well as legal fees and costs. Microsoft has not officially commented on the case.
